Privacy Policy for Mobile Applications, desktop apps and other software provided by PCS Instruments
a) OUR SOFTWARE: This Privacy Policy will refer to and be applicable to all Mobile Applications, desktop applications and other software provided by PCS Instruments (collectively “our Software”).
b) PARTIES: The parties to whom this privacy policy applies are the following:
PCS Instruments Limited, a company registered in England and Wales with registered company number 02112385 and whose registered office address is 78 Stanley Gardens, Acton, London, W3 7SZ (“Data Controller”, “us” or “we”); and
the employees, contractors, personnel and agents of the organisation who uses our Software (“you” or “your”). This privacy policy applies for our customers in the United Kingdom, but also those based overseas, including in the United States.
We are the publisher, owner, and operator of our Software and we are the Party responsible for the collection of the personal information described herein. Being a data controller means that we decide what personal data to collect about you and what to use it for and means that we are under various obligations to look after your data and uphold your rights, in accordance with UK data protection law. We are registered as a data controller with the UK Information Commissioner (the regulator for data protection) under registration reference no. ZA505224.
“Personal Data” means information which can be used to identify you. In particular, we collect and use the following types of personal information about you:
• Name
• Email address
• Phone number
• Job title
• Company name
We also collect the following types of data about you, based on your communications with us:
• Emails or messages exchanged with customer support
• Feedback or survey responses
• Support ticket history
• Subscription preferences
This privacy policy (hereinafter “Privacy Policy”) describes how we collect and use your personal data, as well as your rights in relation to that Personal Data, in relation to your use of our Software. We also have a cookies policy around use of cookies and collection and use of related data. Please see our separate cookies policy below.
This Privacy Policy does not cover any information that we may receive about you and use other than in relation to our Software. Our Software may link out to other websites or mobile applications, but this Privacy Policy does not and will not apply to any of those linked websites or applications.

The location where the data processing activities take place is on our IT systems (which are Microsoft 365 cloud based, who host data at its UK based data centres) and otherwise in our UK office, at the above address.
Where a Customer is based overseas, then we will likely communicate with such customers and this will involve us needing to transfer personal data to the jurisdiction where your organisation is located. We ensure that any such transfers are conducted in accordance with UK data protection law.
We primarily use your Personal Data to help us provide a better experience for you on our Software and to provide you the services and/or information you may have requested, such as use of our Software.
Information that does not identify you personally, but that may assist in providing us broad overviews of our customer base, will be used for market research or marketing efforts. Such information may include, but is not limited to, interests based on your cookies.
Personal Data that may be considering identifying may be used for the following:
a) Improving your personal user experience
When using your data as described above, for the purposes set out in Section 5, we need to identify and rely on a justification under UK data protection law, known as a lawful basis. In the context of such uses of personal data, the lawful bases we rely on are as follows:

We use secure physical and digital systems to store your Personal Data. We ensure that your Personal Data is protected against unauthorized access, disclosure, or destruction.
Please note, however, that no system involving the transmission of information via the internet, or the electronic storage of data, is completely secure. However, we take the protection and storage of your Personal Data very seriously. We take all reasonable steps to protect your Personal Data.
Personal Data is stored throughout your relationship with us plus for a further 6 years after the contractual relationship comes to an end (this is in line with timescales under UK law on limitation periods).
The only parties with whom we routinely share personal data are our IT service providers – with whom we have in place contracts that require such providers to protect your personal data and require that they comply with UK data protection law.
Otherwise, we may disclose your Personal Data to additional third parties if we believe that it is reasonable to do so in certain cases, in our sole and exclusive discretion. Such cases may include, but are not limited to:
a) To satisfy any applicable laws to which we are subject;
b) To respond to requests from law enforcement or other governmental or legal bodies;
c) To bring legal action against a user who has violated the law or violated the terms of use of our Software terms of use;
d) As may be necessary for the operation of our Software;
e) To generally cooperate with any lawful investigation about users; and/or
f) If we suspect any fraudulent activity on our Software or if we have noticed any activity which may violate our terms or other applicable rules
From time to time, we may send you emails containing marketing communications related to our Software such as announcements or other information. If you wish to opt-out of such communications or withdraw your consent, you may contact the following email: info@pcs-instruments.com. You may also click the opt-out link which will be provided at the bottom of any and all such communications. You can unsubscribe or withdraw your consent at any time. Please be advised that even though you may opt-out of such communications, you may still receive information from us that is specifically about your use of our Software or about your account with us. These are not marketing messages, but are service related.
You must confirm that you have read and accepted the terms of this Privacy Policy before using our Software. We employ robust technical and organisational security measures, including across our IT estate, to protect personal data from loss, corruption and/or unauthorised access, in line with our obligations under UK data protection law.
However, you further acknowledge, agree and accept that no transmission of information or data via the internet is always completely secure, no matter what steps are taken. You acknowledge, agree and accept that we do not guarantee or warrant the security of any information that you provide to us whilst in transit, and that you transmit such information at your own risk.
Under UK data protection law, you have various rights in relation to your Personal Data. Specifically, your rights are as follows:

Not all of these rights are absolute and depending on the circumstances, we may not be required to comply with your request (in particular those rights above marked with an asterisk are only applicable in certain circumstances). We will generally respond to your request within 1 month, once we have verified your ID.
